Drug Testing in Schools (Post #9)

In the famous New Jersey v. TLO case, the U.S. Supreme Court ruled schools have the right to search students and their possesions without a warrant if the search is necessary for the maintaining of order and safety.  Recently, a Shasta school district was prevented from drug testing students involved in extra-curricular activities including sports, choir, and clubs, randomly.  The California Supreme Court ruled that the state constitution includes the right to privacy and drug testing is a violation of the right.  The U.S Supreme Court, however, has ruled that schools may drug test randomly.  Share your thoughts including those in the questions below.

Do minors have the right to privacy, when the school seeks to discover if illegal actions have taken place (not directly refrring to drug testing in this question)?

Is something taken from a person's body and tested more private than their possessions?

Why do courts allow schools to drug test athletes only, but not these other groups, too?  Should there be any difference?  And what about students who are involved in no school activities, do they have more rights to privacy than student athtetes?

  1. Students should totaly have the right for privacy. The school should not care what their students do because it's not their problem, it's their parents responcibility. No matter the cause their should always be a warrant so the school could go threw your stuff. In conclusion the school should not even waist money in searching their students because thats not gana stop anything.

  2. Well..thats a tough one. i belive that schools have a right to search lockers, bags ect. because they could possibly posess something that could bring harm to fellow students, teacher and staff. But I dont think they should be drug tested. Some kids could just be...weird, and would take getting forced into a drug test offensive. Especially if a student is tested shortly after school started, I mean, they could have gotten high before leaving for school, then that becomes a problem to be delt with at home. I dont entirley understand why only athletes and club members would be the only ones to be drug tested, that doesnt make much sense to me.

    But on the same token, if you werent doing drugs, then you shouldnt have anything to worry about, if drug tested.

I think that schools should be allowed to test anyone at any time for drugs because it is illegal first of all for kids to be in possesion of drugs and second it is not healthy for the brain or internal organs. Catching them might be the only way. I think drug tests are allowed on athletes because it affects the physicality which is needed a lot in sports but not so much in other activities. I think it would be okay for vehicles to be searched as long as we're insured that nothing will be stolen or violated during the search besides the drugs. If it helps stop minors from being involved with drugs, then I am okay with it.

    -do cops have the right to search vehicles they believe to contain illegal drugs? yes. we ARE minors, we don't really have all that many rights until we are "adults" at the age of 18. and if it is illegal, YES it should be searched for, but only with substantial suspicion.

    -no, you pee in a toilet and flush it away, so who cares. you carry, hold, store, touch, ect. your possessions, they hold more sentimental value.

    - because illegal drugs in the sense of steroids are most prevalent in sports. there shouldn't be discrimination on which groups are tested, all should be tested equally.

    -no, we are minors, we have few if any rights.

    -i didn't know that. but if there is a sign posted, then i have been warned. my only thoughts on this are, I'd laugh when they got into my trunk and found all of my workout equipment and were blasted by the smell of sweaty clothes. i have nothing to hide, search away.

    I do not believe that the school should have the right to conduct random drug testing.We come to school to learn not to be harrassed. If there is reasonable cause well in that case I would say alert the authority or send that student home. But to spend time and resources that could be targeted elsewhere on something so insignificant is ridiculous. As far as the only testing athletes and other students involved in extra school activities goes, I don't think that's right. These students should not be targeted for their being involved in something positive.

  7. Student privacy is an important to all students, and I do not think the government should violate that by checking people's belongings without a warrant. However, I do agree in drug testing. I do not think there is any violation of privacy in drug testing, and schools should have the right to try and protect students from harmful substances. It is unfair that only athletes are tested. If one student is tested, then they all should be.

  8. I think that it is important for schools to check lockers for concealed weapons and drugs, etc. Something that could put us in harm of danger is something worth searched. In the case of drug testing i think everyone should be tested equally and i agree with the court. schools should have the right to drug test you because maybe it would make students think twice before coming to school wasted or high. Also i think regular students should be tested just as much as an athlete, because as Caleb Boyd said ^ "If one student is tested, then they all should be" which makes perfect sense.

  10. I think they do have the right to drug test students and athletes. If people are dumb enough to take drugs then they should be searched. Also they probably only drug test athletes because drugs can highly affect your game play in sports. I think you can search a car in the parking lot, I have nothing to be worried about. :)

    I have mixed feelings about schools being able to drug test students. I do believe that students have the right to privacy, however, if you have to violate their privacy for something as serious as drugs, then so be it. If violating a student's privacy will protect the rest of the school, then I believe it's ok. I don't agree with only testing athletes and students involved in other activities because that is unfair. I agree with Caleb and Katey that if one is tested, the others should be tested as well.

    I think drug testing students is not right. They are also underage wich makes it wrong. I think searching students possssions would only be okay in cases of emergencies. I do think taking something from a person's body and tested is private than their possessions, because students may feel violated and uncomfortable.

    I think schools should be able to drug test their students, especially if they suspect someone. Its not a matter of privacy, drugs are illegal. The schools would only be enforcing the law.

  15. I think that it is fine for school personnel to search a backpack or other bag, but actually testing a person for drugs if a little to far. The ability to randomly search students should not be abused. If someone is suspected of having drugs on their person, then they can be searched, but searching someone just because you can should not happen. This should to apply to either everyone or no one. It is unfair to give certain people more restrictions just because they are doing extra activities. The ability to search ones vehicle is similar to searching their other personnel belongings as long as they make it know that they have the ability to do so.

    Regardless of age, everyone deserves their privacy. Drugs will continue to be a problem in the world, but their use at school is espically prohibited because not only do you harm yourself, but you could also harm thoes around you. I don't think drug testing or locker/backpack searches would be a bad idea, but the idea of it being random wouldn't work out to well. Athletes are tested because if you're on drugs when you play, not only is your judgement impared, but the physical activity mixed with the illegal substance could also affect you health wise. I don't drive, so the searching of my car wouldn't really apply to me. However, if I did drive, I wouldn't have anything illegal in my car. The laws in California are different then any other state because everyone worries about themselves and gets to vote on laws.

  18. I do not think it is okay to search students randomly. That is an invasion of privacy and should not be allowed. Why would they just search athletes and people involved in clubs? Why target those specific people? What did they do wrong? What makes people think that those people are doing something illegal? There is no reason to believe that at all, so don’t do random searches.

    I don't think that the school should be able to do random drug testing. It is an invasion of privacy. I believe that a warrant should have to be provided if a student, or teacher for that matter, had to be searched for drugs.

DAMN RIGHT its a violation! i wouldnt want people looking through my backpack, you might have something personal or maybe something embarssing. if you dont smell like pot or alcohol then you dont have none!     I think that if the school absolutly needs to search for illigle items it should be ok. This power canot be misussed and old nessesary if the outcome could be worse. i think that something taken from a persons body is way more private then their possetions. i belive if there are test done it must be for a good reason and also if a personal possetion is taken there must be a worrent by the judge.
    I think it is more acceptable to drug test athletes over students who dont do afterschool activitys becuse the athletes are competing agensted one another and there needs to be a even playing feild. For clubs and other events it isnt really nessasary becuse there is no physical compitetion. i had no idea that your car can be serched if there was a posted sign. at the same time there would probably be a paper you have to sign agreeing to these demands. California has State laws and every state law can be diffrent depending on the needs. i belive that cliforna has too many laws and should cut back allittle.

  23. i think they should punish those who are cleerly deemed "worthy" of drug testing. not all kids are stupid enough to use drugs, we shouldnt all have to suffer with the criminals.

    I think that schools should only do drug tests if they suspect someone's under the influence. I can understand why they'd test the athletes but to test everyone else? I don't exactly see the logic in that, except for the possibility that they wish to blow away money on making sure everyone's thoroughly clean

  25. i think that it would be ok to do a random drug test on every student wheather they are in sports or not. just because you arent in a sport doesnt mean that you dont do drugs honestly. i mean when you do drugs you might be more willing to fight or harm someone else io would no i lived with drugies for a while and when they were high they seemed to be more abusive and this is a reason y i dont live there anymore. granted it is their choice to take the drug but if it is illegal than it is illegal they shoouldnt be doing it in the first place. yes i already knew that if a sign was posted saying that your car could be randomly searched than it is legal. i personaly have no problem with a new law saying schools can do random drug tests but only if they have a reason to believe that you are taking drugs. and ppl there are ways to hide the smell of anything no matter wat it is sometimes it may be harder than other times but there is always a way. plus some of the teachers have said that the school can now do random breathalizer tests so why cant they now do drug tests if u want to fight this for privacy issues u would have to take up the breathalizer tests as well. and as for the whole cali state laws they have all of those laws and ppl because they feel that they are protecting u from stuff or protecting other ppl from you so they shouldnt back off and talke some off becuase u a minor dont understand all of this and u might comprehend all of this but i highly doubt it. so y dont u wait to complai about hopw many laws we have untill u can fully grasp what those laws mean and y they were put into place in the first place so back to the topic i believe that a randomdrug test, car search, locker search or a body search should be allowed on everybody to insure everybodys safety not only the users safety

  26. On the privacy rights for minors, technically minors are under their parents or legal guardians in care, so the person conducting the search should need to get permission from the parent or legal guardian before conducting the search.
    The fact of students cars being able to be searched is uncalled for. Lockers are schools property whereas a student's vehicle is not. So again, the person/people conducting the search should get permission from the owner of the vehicle before conducting the search.

    I think drug tests are just a bit too personal. The school shouldn't be able to pick a random child to test. Because thats none of their business. If the child is under the influence on campus, that is the only time it becomes a problem. I even think it's an invasion of privacy if the school asks to search bags and lockers. That is the student's personal property. They shouldn't be able to search it "just because". This may sound bad, but if the student keeps their items (legal or illegal) to themselves, then the school has no business with it.

  28. I feel it is acceptable for any student to be drug tested, at any time. However, it is not okay for schools to be able to search through a student's personal belongings without a warrant or probable cause. In addition, I would be pretty mad if my car was searched without my consent!

  30. I think that a random drug test is definatley against a students privacy, but it could help our community more. If the student wants to be in a sport or extra whatever activity then that student should be clean of drugs. The random tests are violating privacy, but it would be different if they told u before randomly doing it. I think that testing is more of a privacy problem than cars. if u were toget ur car searched, then u would have a warning. But the random drug tests would surprise you and if u were on drugs then you would be done. anything can be tested, but with a warning, then i think it would be less of a privacy problem.

  31. I think that drug testing for students in activities like quire and future farmers of America is crazy. They have no reson for a person to be drug tested only to make others students keep away from drugs. There is no proof that this would make other students not do drugs. Athletes are tested because their hasd been usage of drugs in past history. Their was no sign of qoir or future farmers of America students being involved with drug usage. many states have differnet laws that allow different things.

  32. I understand the idea of using drug testing in our schools, especially for atheletes and students involved in extra curricular activities. Students involved in extra curricular activities and atheltic programs represent their schools when traveling to other cities. Also, a part of a school's job is to provide safety for its students. So therefore, a school should have a right to interfer in a situation where drug use is involved. Another reason,and a completely obvious reason, that schools possibly should have the right to do drug testing is that drug use is ILLEGAL. Authorities should be able to control situations that are dealing with violating American laws, especially for minors.

  33. I think minors do have the right to privacy, I'm pretty sure adults don't like their things looked through, as do we. If something is taken from a person's body and tested is the same as someone's possessions because its yours. courts allow schools to drug test athletes only because they might have a higher chance of having something? No there shouldn't be a difference if they're checking athletes only they should check everybody else. I think its wrong because that's another invasion of privacy, its not right to go through someones car, belongings, ect.

  34. Students have the right to privacy, but at the same time i believe that drug tests are important. They should be done only if there is strong reason to do so, or if the person is in sports. The reason for this is that there is greater need to be fit in sports, and some see drugs as the only way to attain their goal. If drug testing ends up being allowed on campus, then the number of people doing drugs will decrease obviously because no one will want to get caught.

  36. privacy is somthing every student should have in school. personal possesions like bags should be respected. on the other hand the school should have the right to search a student if they have proper evidence that drugs or anything that may pose a threat to the student body and staff is in their possesion. random drug test on the other hand should not be allowed because there is no formal evidence to indicate the drugs are being used therefore random drug tests should not be allowed.

  37. in my opinion the school should not be wasteing money on drug testing there students, they have much better things to spend there money on such as reducing class sizes, getting back all the extra classes like woodshop and even improveing the school food so kids arent forced to leave at luch to eat. After all that then worry about who does drugs

  38. I believe that students should always have the right to privacy. I completely disagree with the fact that students should be checked randomly because it would only make one feel uncomfortable. On the other hand I agree that athletes should be tested for drugs because its important to be healthy and in good conditions before joing a sport or an activity. This shouldn't be a problem for athletes because they should know better than to be doing drugs. Athletes always have to fill out a couple of forms before joining a sport and in one of those forms should ask permission to test athletes. I think that they should always ask permission before doing any actions because no one would like it if someone got into one's personal bubble.

I also understand about the athletes because they shouldnt be using any type of enhancing drugs to help them perform better thats cheating and they should be taken of they team. It is also sort fo invadeing privacy but thats the risk you take for takeing them in the first place

  40. WELL FIRST OF ALL THAT DRUG SEARCH THING IS TOTAL BS BECAUSE IT TOTALLY INVADES ONES PRIVACY. THE SCHOOL IS TOO OVER PROTECTIVE. WHAT DO THEY CARE WHAT THE STUDENTS DO AFTER SCHOOL HOURS? I BELIEVE THAT IF A SCHOOL HAS RANDOM DRUG TESTS THEN THE WHOLE STAFF SHOULD PARTICIPATE AS WELL. PERSONALLY I THINK THAT IS JUST DUMB TO RANDOMLY DO TESTS OR BE ABLE TO CHECK OUR BELONGINGS.     I think schools have the right to be able to drug test students for extra circular activities because it isnt right to have people on their team who do illegal things. It can risk the lifes of students who are not careful and put unwanted pressure on kids who dont do it. it does invade the privacy of students but if their not doing anything wrong then they have nothing to worry about.

  42. Drug testing for sports would be a great idea as it would narrow down the use of it among teens which could lead to more responsible adults. Drugs create habits and if it could be prevented in sports then it would be great for the states. It wouldnt be an invasion of privacy if the students knew they were being drug tested.

This is dumb to even mention because it's not like the government even has enough money to do this in the first place. honestly who cares about the drugs.. why drug test athletes?! it'll make them worse so theres no competition there if anything test for steroids!! i know so many guys that take tren and crap! test them if anything not the whole school.

  45. They should be allowed to check lockers, its school property. Athletes and club members should be checked, if something were to happen due to drugs, our school would get a bad reputation. Like a basketball player overdoses on something in the locker room, it'll be the first thing on the news the next morning. I disagree with them having the right to check cars, I don't want some stranger hopping in the front seat of my car just because they have a feeling that I might be in possession of something illegal. That's my property and in that case, I would park elsewhere. Let them check or search (not test) students randomly, if students are stupid enough to bring illegal substances to school, they deserve to be caught. They don't have the right to force me into a drug test, I don't have anything to hide, I just think it's not right. If I am involved with the school like sports or clubs, then go ahead and test me. I don't attend school to take drug tests. I take enough tests as it is in my classes.

  46. i believe that school have the right to search backpacks and lockers if they have a good enough cause and a car if it is on school campus. i do not think that they should be able to drug test. if they catch you doing drugs they they can kick you off the team but its not their business to just randomly go out and test people

    I believe that every minor should have their own rights. Therefore schools should not have the right to "randomly" drugg test students, for it is an invasion of privacy. Personally I believe if a teacher or admin. has to "drug test" a student they should contact the parents first and recieve permission. We are only teenagers and some of us make mistakes. Now as for athletics, I believe "drug testing" for things such as steroids should be issued. It is unfair and wrong for athletes to be subjecting themselves, their team, and highschool to that kind of immaturity. Personally I believe drug tests, with permission of a legal guardian should be able to be authorized at local and national hoghschools.

  49. Are schools liable for drug induced behavior during school hours or on school property? If so, i believe the school has the right to search belongings and people for illegal substances in order to protect themselves from legal action. For instance, if a student gets drunk during school hours, peels out in the parking lot and kills someone, then will the school be sued by the parent for not safeguarding their child? Shouldn't the school be able to protect the rest of the student body by doing what is necessary to prevent such actions? Even though athletes more directly represent a school, testing and searches should apply to all students, not just athletes.

I think all people under the age of 18 older then 18 in or out of school should all have the right to there own privacy.The school system has no right to look through there personal stuff with out a warrant.They should only get the right if it will harm someone in any kind of way.I think the only reason why school only test athletes an not all students id because that person is representing that school so they should have the right to test that student in anyway cause there putting there insuranceon that person .

  53. My belief towards drug testing randomly is against it. I strongly believe that people including students should have their privacy especially if itmeans searching your car that is too much and they should have a warrant to search a car. I understand that students under the influence is an issue but not all people use drugs so why bother wasting so much time on it. They should only drug test those whom they have suspicions upon and i think that the parents should have consent of this.

    I believe that this is actually good. Students join a sport and have to do certain things to play that sport, like good grades. Drug use obviously isn't allowed and the school has a right to check in and see what's going on. They agreed to these things by joining and technically they are under 18 so they don't exactly have that right yet. They signed up for it and shouldn't fuss over it. The school has a right to know about their students so things can be done or so. Either way i believe this isn't an invasion of privacy.

Most High Schoolers would test positive on a drug test, it would just be a waste of time to test everybody, and then what would the school do? they wouldn't turn every student into the police. I believe that it would be a waste of time and an invasion of privacy. But i do believe that athletes should be drug tested for steroids and other illegal drugs while participating in a sport for the school.

I think that if the school staff beleives that a student is putting others in danger they should be able to search their stuff.searches sould not be done randomly only on the people who look suspicious.

Athletes are an easy group to pin, because many people who would contest the random drug testing of all students don't contest the drug testing of athletes. States can add to people's freedoms, but cannot take away freedoms that are given to people in the US constitution.

This does not affect thier school activities. Unless maybe if they've been attending school blown out of thier minds thats a good reason to test that individual person.   65. For the state of CA, I think schools shouldn't be allowed to drug test because the Supreme Court gave states the right to chose if they would allow drug testing. However I think it's okay for schools to drug test because its purpose is to try and make the school as safe as possible. While i understand why only athletes are tested, I think to be fair all students should be subjected to the random drug tests, if the state allows them.

I belive its not right that schools choose to drug test particular students and belive that the others have more privacy than them.I belive its ok for schools to drug test randomly once in a while but it is like an invasion of your privacy.Its ok for schools to search your locker because its their property on school grounds.The school searching your car is a different story because thats your belonging not the school's.The only exception is if many suspects had reported that they actually saw drugs or something dangerous in your car.California passes different laws from other states because each government runs their state differently.

    I think that under certain circumstances should privacy be violated. The school has the right to search backpacks/lockers/purese because something could harm another student. Drug testing, well i think that random drug testing is weird and a little over board. But if a student seems suspicious or looks like they have been doing drugs then i think with legal guardian permission and/or the police, the school could do a drug test on that person.

  71. Many students consider a search for guns and drugs on a school campus to be necessary, but many consider the search of a person to be an invasion of privacy. I believe it can be justified. Drug abuse is a serious matter, especially on a high school campus. If there's reason to suspect abuse, it's absolutely justified to test those students for their own safety, as well as the safety of others. Many jobs require a drug test before they'll hire you. That being said, I do think random searches seem a bit excessive. Only on the suspicion of illicit activities should students be searched, or when use could harm the person, such as athletes.

  74. I believe that the school has every right to randomly give drug tests to those students in extra curricular activities, especiall sports. These students are meant to represent our school and be a good example and they can't achieve that if they truly are on drugs. As well as it would help to get rid of a potential addiction for a student before it gets bad enough. While it does seem like a privacy issue, however if the school were to inform the parents before school enrollment or the school year then it should be allowed.

  75. Well i think that its a violation of privacy, but faculty and staff does have the right to know what's going on in a student's life, especially if they are involved in school activities. It can help our community grow, and it lets our adults know the kinds of things that go on in our society, and maybe they can help us with that growing problem. Also, it can help our schools be more aware of what goes on behind close doors. Just the same way cops have a right to go through our possesions, schools should have the right to as well, because at the end of the day we are all minors.

    i think that it would be ridiculous to search students without a warrant. If there is a reason to searching that student, go for it. But if that student shows no sign or they aren't doing anything wrong, why should they be searched? If there is a student that has had a past of drugs and alcohol at school then they should be searched or have a random drug test. But not all students do that. I guess I understand that courts would want to test athletes, because of steroids and what not. But that's still not far because most likely those athletes aren't doing as many drugs as any other student, if they were.

  77. i believe the school has the right to test students in sports and maybe even band and drama but the school shouldn't have the right to search cars without a search warrent, specially if the owner of said car is not there. The school probably shouldn't test students who participate in school activities bacause this may drive students participation down, not because they fear something but peeeing in a cup can be uncomfortable for some. the school could thoght test club officers or such.

  78. Personally, I don’t think too much of the situation. People shouldn’t be worried about drug testing especially if they aren’t on drugs, and if they are then they’re going to get caught. But they shouldn’t have been doing them in the first place! So in a way it serves them right. But I do see how it’s a violation of privacy to an extent. I still don’t think it would matter. If kids are on drugs it totally can affect the school so I don’t see a problem there. The school should know if they have kids on drugs at the school. And the reason the schools test the athletes are because they are representing their school. They don’t want some druggie on their soccer or football team; it gives them a bad reputation.

  83. I believe that searching a students' belongings should be allowed as long is there is a good reason, like suspicions of a weapon or anything dangerous. Drug testing, however, is going too far because that is more personal. If students are not doing drugs during school hours or on school propety, technically they are not violating school rules even though they are breaking the law. In the case of sports I can understand how drug testing could be debated due to enhancement drugs, but I still think that is a matter for police and not schools to handle.

Just because one kid dresses like a stoner, doesn’t mean you have to right to “randomly” drug test them. That seems a bit ridiculous. Nothing makes any student any more trustworthy than another. And, yes. I should think that taking something from my body is a bit more personal than searching my backpack. Granted they both belong to me, so I wouldn’t want anyone in either of them. But you’re body is your business. End of story. Drug tests in sports is because they are competitive, and relate to the image of the school and state in regards to other districts, and the state doesn’t want a bunch of steroid using stoners on the football team. I sure wouldn’t. As far as anyone having more privacy than another…no. They do not. Stay out of my car. And California can have differing laws because of the 9th amendment I believe. If a school does decide to do a drug test, they still can't do anything about it if school officials know that many of their students are doing drugs. All they can do, or should be able to do at the most, is know that information. The school does not have the power to stop one from doing drugs, so I don't see it as a problem. When it comes to searching one's car for drugs, I believe that the school does not have the right to search our cars. I do not believe that cops have the rights either, but it's their "job" to, so therefore, they should be the only one allowed to.

    As a minor, your rights are extremely limited. Your parents/legal guardians are responsible for your actions until your 18th birthday. Unlike most other places, schools do not need probable cause to search you they only need reasonable suspicion. During the school day it is the administrators' duty to keep students safe. By searching one person, they could subsequently be protecting hundreds of other lives. There is no reason that the school should not be able to drug tests students randomly. Almost all employers make you take a drug test before they will hire you and can have you randomly submit to drug testing before one of your shifts. If you have nothing to hide, it shouldn't matter anyway. You will have to deal with drug tests for the rest of your life.

    i think that schools should have the right to drug test if they have a reason to be suspicious of a student. i think the school should have all parents sign a waver to consent to drug testing if it is necessary at any time during the year, and if the parents say no, the school should need hard evidence before testing. if the parents consent to this testing when necessary, then the students would have no way to get out of this test, they could not say it is a violation of their privacy. as for testing athletes, they should only be singled out if steroids are suspected.

    in a way i see this is just going down hill.

  115. I believe that any school, be it private or public should be able to under any circumstances test their students for drug use. It is only for the good of students that this be done. I do not see it as an invasion of privacy in any way. The state states that the consumption of Marijuana is illegal and punishable by jail time. Wouldnt this be the same exact thing on a public school campus were this school is funded and supported by the government. There for students should be made to comply with drug tests.

If schools started random drug testing, half of that money will be gone because a bunch of kids would get expelled or suspended. So no, students should not be drug tested at school.     Everyone deserves their privacy no matter what age they are, unless, they have proven they can't be trusted and they are either putting themselves or others at harm. If you have done nothing wrong and are a good citizen there should not be a need for random drug testing.   128. I believe that schools should not be able to do drug tests unless the student or staff is found with drugs. Even if the school did have this policy I don't think it would be enforced well. An example of this is the cell phone policy. It has been at Galt High for years and is just now starting to be enforced, or so they say. If we had this policy it would be very loosley enforced and be a hassle to the students and faculty.

    Schools should have the right to search for illegal objects if it is necessary for the maintaining of order and safety of the school and the students, but the searches shouldn't be just aimed at random students or classes and they shouldn't go as far as searching pant pockets unless a law enforcement officer is conducting the search. The school however shouldn't conduct the drug tests without the parent's consent, if the student refuses to take the test. Minors do have a right to privacy and the school staff conducting the search should give a reason to why the student is being searched.

  134. I do believe that students should be given the right of privacy, but when it comes to illegal substances I don't see a problem with random checks. The only people that should have a problem with this would be those with something to hide, and I have nothing to hide. So if schools want to crack down on kids for breaking the law, I believe that they should be able to.

  135. I think that a student that is enrolled in a sport, or band, or anything that requires participation outside of school hours should be allowed to request for drug tests. When you are picked for a team, the coach or director, or whatever is looking for good players that will do their duty well, and have the right to be selective. When you apply for a job the employer has that right, and I think it's pretty much the same idea. However, I do not feel that it is right to ask regular students randomly for drug tests. That is an issue unrelated to school (unless of course a kid is smoking a joint on campus--that is a very different matter) and therefore it is not the school's right or job to test for it.

    I believe testing or searching students is ok in some ocassions. I believe its ok if they suspect that they have an item that can harm other in the case of drug testing i think its ok if they believe that they are users and i think the parents should consent it.

  137. I believe thats states have the right to decide what goes on and what doesn't go on in schools, however certain rights do not apply for minors and privacy is one that may not be given especially with drug use on campus being so high.

I think random searches and drug tests for anyone,not just athletes,is wrong.If the school has a suspicion on a group or a particular student that may be using drugs then i think it would be ok,if the student was notified.Whatever is in students' bodies or in pockets/backpacks is the buisness of the student unless it does become a problem with the safety of other people.

We are forced to go to school, this isn't a job that we go looking for ourselves. It's required. I think that drug testing students would only lead to further problems. Searching is different. If it is on the student's possession on school campus, it's against the law and the schools rules.

  141. I think that certain laws that have been put into place such as drug testing in schools should be allowed with parent consent or like prior run ins with the police. As far as testing atheletes, thats ridiculous. We don't get paid to play sports, and it's our business and sometimes our parents business what gets put into our bodies. At 17, i think i should have a little more privacy when it comes to what i do on my free time with my bodie. I believe the school has the right to search you and your car if on campus. But if your car is not on school campus, i dont think they should be allowed to do it. If you're doing drugs, you shouldn't be bringing them to school.

  142. I dont think students have the right to privacy, especially in the case of illegal substances. With illegal substances in mind, it is not only against the regulations of the schools' sports systems, but against state law. But I do think yes to these students having the right to privacy, but if they sign the contract to play a sport it means that the school is allowed to run these drug tests. Drug tests are not an invasion of privacy, because you have the right to deny the action of taking a test at the cost of not participating in a sporting event.

I believe that we do have our right to privacy, but in reality, there is no point to go searching people's possessions and person to find drugs or whatever, because no matter what the situation, kids will still find a way to do those drugs. So, searching really doesn't do too much, and it's not really worth the cost to have people search things anyway.

Well Ryan thinks that he has no clue why they would test choir students but on the fact athletcs depending on sports should be tested in all fairness if one persons doing it then the whole team should do it. Sports like baseball still have to hit aa ball tennis it wouldnt realy help only track and football will roiads realy help you. Ryan still thinks that a school depending on the situtation or pryor effences should have a right to test a student. About the cat thing ryan thinks that it wouldd be fine if the signs they have posted or said are everywhere and in big print to read but if they search cars for the hell of it thats wrong they should ahve a reson like seeing a knife in the seat but if the car is perfectly fine then they shouldnt be able to. As for testing students for drugd that not realy good because this isnt a job its schhool and as long as your here making money for the school whp cares what your on

  145. I believe drug testing the athletes at a school would be absolutely absurd. First of all, I believe drug testing is pointless in the first place. Unless a person shows obvious signs that they are not functioning properly, then who cares? If they act normal, let the person do whatever they want to do in his/her free time, it's not affecting you so it shouldn't matter. At a school, the pointless idea of drug testing is taken to another level. Not only is it an invasion of privacy and therefore would be a pain in OUR side, it would also be a pain for the school. For one, there probably would not be many athletes left as this is high school, the time everyone likes to "test out" different ways of life. For two, there probably wouldn't be as much money left as we sure as heck would not be forced to pay for our own testing. Who knows what this lack of budget would lead to? Overall, I do not agree with drug testing and when if it were to be forced upon me, I have an even stronger standpoint. Go ahead and search our cars/lockers/backpacks as much as you want as there is reason for that (we could be in possession of weapons, etc.) but stay out of our personal lives.

    The more you publish yourself, the less privacy you have. Actors and singers have none, while that secret person in the corner has a lot of privacy. For sports and everything they publish themselves a lot more.

However, testing students randomly is an infringement of their privacy. schools should not have the power to be involved in the private/ non-school life of its students.

So if a student wanted to get perplexed before a game that could potenially ruin a schools name if amnyrthing where to go wrong at the game. that would be dreadful other schools thinking Galt High as a drug school.   152. If a body of students qre drug tested all should be drug tested. Encouraging students to be involved in school activities is often a difficult task. If students that are not involved in school activities did not have to get tested, as opposed to athletes, they may use that as an excuse not to be involved at all. I believe drug testing would somewhat prevent the use of controlled substances. Searching cars, however, is an invasion of privacy.The fear of getting in trouble keeps students from doing things they should not be doing.

  153. Because drugs are already illegal, it should be policy of schools to drug test athletes, which would sort of screen out bad students from being athletes as well. However, it would be much too costly to enforce a school-wide drug testing, so all that can be done is simply making sure no drug activities are taking place on school campus and such.

    I do not think that the school should be drug testing all of its students. It seems like a violation of privacy to be drug testing every student, especially if there is no suspicion of illegal activity. The schools' are broke as it is and the whole drug testing thing would just put another strain on the budget.

  158. In my opinion if a school were to have a big drug and weapon problem then they should have checks because this could be harmful to students and teachers. Also with the random car checks I don’t think that should really be necessary unless they are able to get a warrant or the students parent permission.

  160. Schools do have the right to check school lockers for illegal items because the lockers are school property. They do not have the right to search student bags or the students them selves without a suspision and a warrant as said in the constitution. When it comes down to drug testing i believe students who are being tested on a regular basis should not be exempt from extra curricular activities such as sports and etc. This will only discourage students and it limits there chances at becoming more than just someone who does drugs.

    The way I look at drug testing in schools are like this. If you wish to take place in a sport or something that is not a mandatory school activity, then you have no right to be tested. People say that you do because you are in school, so your rights leave you. But You are forced to go to school, so you must have your rights with you at all times to defend yourself.

  165. I beleive it would be a waste of time and money to drug test. Students are minors anyways and they usually do not get in any trouble. Drug testing of athletes is the only way I see schools drug testing. It is one thing to search students but I believe it is agnaist the rights to drug test
